JOLLYCOOK 2009 ORIGINAL RECIPE CONTEST OFFICIAL RULES
NO PURCHASE NECESSARY. PURCHASE DOES NOT INCREASE YOUR CHANCES
OF WINNING. ENTRY IN THIS CONTEST CONSTITUTES YOUR ACCEPTANCE
OF THESE OFFICIAL RULES. DO NOT ENTER THIS CONTEST IF YOU ARE
UNDER THE AGE OF EIGHTEEN. VOID WHERE PROHIBITED.
1. ELIGIBILITY REQUIREMENTS: Open to legal residents of the
U.S. who are 18 years of age or older at the time of entry.
Employees, contractors, directors and officers of JollyCook and Continuative, LLC. ("Sponsor"), its parent,
subsidiary and affiliated companies, retailers, distributors,
licensees, licensee's employees, manufacturers, web design,
advertising, fulfillment, judging and Contest agencies
involved in the administration, development, fulfillment and
execution of this Contest (collectively, "Contest Parties"),
and the immediate family members of each (spouse, parent,
child, sibling, grandparent, and spouse or "step" of each) and
those living in their same households (those persons whether
related or not who live in the same residence for at least
three months during the twelve-month period preceding the
start date of the Contest) are not eligible to participate.
2. CONTEST PERIOD: Contest begins on 12/5/2008 at 12:00:01 am
Mountain Standard Time ("MST") and ends on 12/4/2009 at
11:59:59 pm MST (the "Contest Period"). Sponsor's time clock
is the official clock for this Contest.
3. TO ENTER: Log on to
www.jollycook.com ("Web Site") during the
Contest Period. Entries without complete entry form
information will automatically be discarded and are not
eligible for a prize. Entries submitted without an original
recipe will only be eligible for a Third Place cash prize. All entries become the property of
JollyCook and Continuative, LLC. Follow on-screen directions
above to properly complete an online form to be entered into
the Contest. Once your registration is complete you will
receive one (1) entry into the Contest. Automated means of
entry (bots) are prohibited. Limit one (1) entry per person
and/or email address per month during the Contest Period. A
valid e-mail address and confirmed free subscription to the
JollyCook Recipes Direct Newsletter is required to enter. E-mail
address used to enter Drawing/Contest MUST MATCH the
newsletter subscription e-mail address. If your not currently
a subscriber you will automatically be added to the newsletter
list, which still must be confirmed. Should multiple users of
the same e-mail account enter the Contest and a dispute
thereafter arises regarding the identity of the entrant, the
authorized subscriber of said e-mail account at the time of
entry will be considered the entrant. "Authorized subscriber"
is defined as the natural person who is assigned an e-mail
address by an Internet access provider, on-line service
provider or other organization which is responsible for
assigning e-mail addresses or the domain associated with the
submitted e-mail address.
4. PRIZES, DRAWINGS, ODDS AND APPROXIMATE RETAIL VALUES ("ARV"):
Winners of the Grand Prize, Second and First Prize will be selected
by an internal panel of judges, entries without a recipe will
be selected using a random generator (script) of active
newsletter subscribers from
all eligible entries received. Odds of winning a Contest prize
depend on the number of eligible entries received.
Contest winners will be selected and announced on or about the 5th of
January 2010 by Continuative, LLC., with an internal group
acting as the judging organization ("Judges"), and whose decisions shall be final and binding on
all matters relating to the Contest. Limit one (1)
prize per person, household and/or email address per contest
calendar year.
ONE (1) GRAND PRIZE: a $500.00 pre-paid COOKING.COM gift
card. Approximate retail value ("ARV") of Grand Prize:
$500.00 USD.
ONE (1) FIRST PRIZE: a $250.00 pre-paid COOKING.COM gift card. ARV:
$250.00.
ONE (1) SECOND PRIZE: a $100 pre-paid COOKING.COM gift card. ARV:
$100.00.
TEN (10) THIRD PRIZES: a $15 cash prize (paid by bank check). ARV: $15.00 each.
All gift cards are subject to the terms and conditions set by
issuer.
TOTAL ARV OF ALL PRIZES AVAILABLE IN THE CONTEST:
$1000.00.
5. GENERAL CONDITIONS: The words "Contest" and "Drawing" are
used interchangeably in this document to mean the same thing,
we are offering a free drawing at no cost to subscribers of
our free newsletters. No offer of gambling is made or implied
by the word contest. Winners are solely responsible for all
federal, state and local taxes on their respective prizes. No
cash equivalent or substitution of prizes is offered, except
at the sole discretion of the Sponsor. No transfer of prizes
will be permitted. By participating, entrants agree to these
Official Rules and Sponsor's Privacy Policy (available at
www.jollycook.com/privacy.html) which are final and binding
in all respects. Unclaimed prizes will not be awarded. Prize
Winners will be notified by e-mail and by regular U.S. postal
mail and will be required to complete, sign and return an
Affidavit of Eligibility/Liability Release, and, where lawful,
a Publicity Release including a self produced photo (head
shots acceptable) within fourteen (14) days of attempted
notification or prize may be forfeited. If a prize, or any
portion thereof, cannot be awarded for any reason, Sponsor
reserves the right to substitute prize with another prize of
equal or greater value. If for any reason the Contest is not
capable of running as planned, including infection by computer
virus, bugs, tampering, unauthorized intervention, fraud,
technical failures, or any other causes which corrupt or
affect the administration, security, fairness, integrity or
proper conduct of the Contest, Sponsor reserves the right, at
its sole discretion, to disqualify any individual who is
responsible or who tampers with the entry process, and to
cancel, modify or terminate the Contest. CAUTION: ANY ATTEMPT
BY YOU OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB
SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY
BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN
ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES
FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
In the event of cancellation, Sponsor will award all prizes in
a random drawing from eligible entries received as of the time
of cancellation. By accepting prize, winner acknowledges that
neither Sponsor nor its directors, employees, or agents, have
made nor are in any manner responsible or liable for any
warranty, representation, or guarantee, express or implied, in
fact or in law, relative to any prize, including but not
limited to its quality, mechanical condition or fitness for a
particular purpose. Any and all warranties and/or guarantees
on a prize (if any) are subject to the respective
manufacturer's terms therefore, and winners agree to look
solely to such manufacturer for any such warranty and/or
guarantee. This Contest is offered only in the U.S. and is
governed by the laws of the state of Utah. Venue for
resolution of any and all claims arising from or related to
this Contest shall be limited exclusively to a state court of
competent jurisdiction located in Salt Lake County, Utah, or
the United States District Court for the Northern District of
Utah.
6. LIMITATIONS OF LIABILITY AND RELEASE: No liability or
responsibility is assumed by Sponsor or Contest Parties
resulting from user's participation in, attempt to participate
in the Contest, download of any information in connection with
participating in the Contest. No responsibility or liability
is assumed by the Sponsor or Contest Parties for technical
problems or technical malfunction arising in connection with
any of the following occurrences, without limitation, that may
affect the operation of the Contest: hardware or software
errors; faulty computer, telephone, cable, satellite, network,
electronic, wireless or Internet connectivity or other online
communication problems; errors or limitations of any Internet
service providers, servers, hosts or providers; garbled,
jumbled or faulty data transmissions; failure of any e-mail
transmissions to be sent to or received; lost, late, delayed
or intercepted e-mail transmissions; inaccessibility of the
Web Site in whole or in part for any reason; traffic
congestion on the Internet or Web Site; unauthorized human or
non-human intervention of the operation of the Contest,
including without limitation, unauthorized tampering, hacking,
theft, virus, bug, worm; or destruction of any aspect of the
Contest. Sponsor is not responsible for any typographical
errors in the announcement of prize or these Official Rules,
or any inaccurate or incorrect data contained on the Web Site.
Use of Web Site is at user's own risk. Sponsor and the Contest
Parties are not responsible for any personal injury or
property damage or losses of any kind that may be sustained to
user's or any other person's computer equipment resulting from
participation in the Contest, use of the Web Site or the
download of any information from the Web Site. By
participating in the Contest, the entrant thereby releases
Sponsor and the Contest Parties from any and all claims,
damages or liabilities arising from or relating to such
entrant's participation in the Contest. By accepting a prize,
recipient (and recipient's parent or legal guardian if a prize
Winner is considered an eligible minor in his/her state of
residency) agrees to release and hold Sponsor, Contest
Parties, and all of their respective officers, directors,
employees, representatives and agents harmless from any
liability for injuries, losses or damages of any kind to
persons or property resulting in whole or in part, directly or
indirectly, from participation in the Contest; from
acceptance, possession, misuse or use of a prize including but
not limited to liability for taxes, duties or other levies
assessed upon any of the prizes.
7. WINNERS LIST/OFFICIAL RULES REQUEST: For list of winners,
or a copy of these Official Rules send a self-addressed,
stamped envelope specifying "Official Rules" or "Winners
List", postmarked by 1/10/2010 and received by 1/31/2010 to:
